Guardianship

Guardianship

The Illinois Probate Code includes extensive provisions for guardianship of a Minor Child or a disabled adult.
A disabled adult is a person 18 years or older who has a mental illness, physical incapacity or developmental disability that causes the person not to be able to fully manage his or her person or estate. A Court may consider a person disabled who because of gambling or substance abuse exposes him or herself and family to want and suffering.
Guardianship of a Minor Child can form an important legal protection for the child and the adults involved in caring for the child.  Guardianship is different from adoption in many ways.  Perhaps the most important distinction is that with guardianship, birth parents do not lose their parental rights.
As an attorney, Ellyn can work with families on how to best care for a disabled adult and how to best care for a Minor Child through either guardianship or adoption.
