Persons who adopt children who are related to them can go to Court on a streamlined procedure and an efficient timeline.
A related child is defined by the Illinois Adoption Act as related to the prospective adoptive parent as "parent, grand-parent, brother, sister, step-parent, step-grandparent, step-brother, step-sister, uncle, aunt, great-uncle, great-aunt, or cousin of first degree." 750 ILCS 50/1(B)
Birth parent rights need to be handled either through voluntary consent or Court termination before a person can adopt a child, even a related child. Therefore, although a related child adoption is simpler, it is still given careful attorney attention all the way through finalization.
